Điều Tu Chính số 2 của Hiến pháp Mỹ ghi rõ :

"Một lực lượng dân quân tự vệ được điều tiết chặt chẽ
là cần thiết để giữ an ninh cho nhà nước (bang),
vì thế quyền giữ vũ khí của người dân (trong dân quân tự vệ)
sẽ không được vi phạm (hay bị giới hạn)".

Tư nhân có quyền mua vũ khí và họp nhau lại thành dân quân tự vệ, như vậy, quyền giữ vũ khí của tư nhân được Hiến pháp bảo vệ

Dựa vào Điều Tu Chính số 2 nói trên, bất kỳ dân Mỹ nào trên 18 tuổi, không có tiền án, không bệnh tâm thần đều có quyền mua và giữ vũ khí
